These Terms of Service ("Terms") govern your access to and use of the Papaya Consent Checker tool, including our command-line interface (CLI), web application, and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.

1. Description of Service

Papaya Consent Checker provides automated privacy compliance testing tools for websites. The Service includes features such as: * Consent Analysis: Analyzing website behavior before/after cookie consent interactions. * GPC Analysis: Testing website responses to Global Privacy Control signals. * Reporting: Generating reports on detected trackers and cookies. * AI Insights: Providing automated summaries and chat-based assistance regarding the analysis results.

2. Your Responsibilities

You are solely responsible for your use of the Service. You agree not to use the Service for any unlawful or unauthorized purpose, including but not limited to: * Scanning websites without authorization, where such authorization is required by law or the website's terms. * Using the Service to launch denial-of-service attacks or otherwise disrupt the operation of third-party websites. * Reverse engineering or attempting to extract the source code of the Service (except where permitted by law or open-source license). * Misrepresenting your affiliation with Papaya Privacy Co.

3. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

  • No Legal Advice: The reports, summaries, and AI-generated insights provided by the Service are for informational purposes only. They do NOT constitute legal advice. Compliance with privacy laws (e.g., GDPR, CCPA/CPRA) is a complex legal matter. You should consult with qualified legal counsel regarding your specific compliance obligations.
  • Accuracy: We do not guarantee the accuracy, completeness, or reliability of the analysis results. Tracker detection relies on third-party blocklists (e.g., DuckDuckGo Tracker Radar) and AI heuristics which may produce false positives or false negatives.
  • Website Changes: Websites frequently update their code and tracking technologies. A report generated today may not reflect the website's state tomorrow.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PAPAYA PRIVACY CO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

5. Fees and Payment

  • Free Tier: We may offer a limited number of free tests per user.
  • Subscriptions: Paid subscriptions are billed in advance on a recurring basis (e.g., monthly). You authorize us to charge your payment method for the subscription fees.
  • Cancellation: You may cancel your subscription at any time via the account settings. Cancellation will take effect at the end of the current billing period.
  • Refunds: Refunds are generally not provided for partial subscription periods, except as required by law.

6. Intellectual Property

The Service and its original content (excluding user-generated reports), features, and functionality are and will remain the exclusive property of Papaya Privacy Co and its licensors. The Service is protected by copyright, trademark, and other laws.

7. Third-Party Links and Resources

The Service may contain links to third-party websites or services that are not owned or controlled by Papaya Privacy Co. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
